(Publishing-NewsWire.com, July 20, 2013 ) San Francisco, CA -- Bail was set at $30,000 Wednesday for a Hermon resident, Robert O. Peak, 53, who is required to register as a sex offender for the rest of his life because of a previous conviction. He was arrested again by Andrew Whitehouse of the Penobscot County Sheriff’s Office and charged with Class A gross sexual assault with a person under the age of 12, as well as Class unlawful sexual contact.
In prior history, Peak was convicted of eight counts of gross sexual assault with a minor under the age of 14 and sentenced to 9 years in prison. He spent five years in prison and then another six on probation. Penobscot County Prosecutor asked the judge on Wednesday to set Peak’s bail at $100,000 based on his criminal history and be barred from contacting the victim or her family, as well as any children.
Peak’s attorney, Ben Fowler, says this is all an innocent misunderstanding and asked for bail to be set at $2,500.
District Court Judge Buce Jordan responded by saying that while a Class A felony is extremely serious, the state’s request was too high, setting the bond at $30,000 and fulfilled the prosecution’s request barring contact with the victim, her family and all children.
On July 3rd, Whitehouse received a referral by the Department of Health and Human Services. According to court documents, the referral was based on Peak “playing games” of sexual nature with a five year old girl. When interviewed, the girl said was made play a secret game that involved touching their genitals.
During his interview, Peak blamed the girl for getting on top of him while he was sleeping. Later in the interview, however, he admitted that on Valentines Day he had sexual encounters with the girl.
As of Wednesday evening, Peak was still in jail.
